Explore The Inclusive Side of Singapore

  1. By using the app, you (also referred to as “Users”) are deemed to have read, understood, accepted and agreed to these Terms & Conditions, which are valid and binding on you. If you do not agree to, or fall within, these Terms & Conditions, please do not use the app.
  2. These Terms & Conditions constitute a legal agreement between B-Change Technology Pte. Ltd. and you and may be updated from time to time without notice. By continuing to use the app, you will also be deemed to have read, understood, accepted and agreed to these Terms & Conditions, as updated.


The objective of the “Explore the Inclusive Side of Singapore” campaign is to encourage participants to use the Be Inclusive app to collect data on the inclusiveness of various locations and services in Singapore. Users earn points when they use the app, which may be exchanged/redeemed for non-cash rewards provided that conditions are met. The campaign runs from November 20, 2017 to November 30, 2017.

1. Operator

B-Change Technology Pte. Ltd. (Singapore) (also referred to as “B-Change”) markets and operates the “Be Inclusive” app globally under license from B-Change Foundation, Inc (Philippines) (also referred to as "The Owner").

2. Intellectual Property Ownership

All intellectual property including copyrights, trademarks, names and logos used on/by the “Be Inclusive” app are (unless otherwise stated) owned by the B-Change Group. Use of the app does not permit the User to infringe those rights or the rights of the third parties which may exist in material contained in the app. No license is expressly or impliedly granted as a result of your use of this app. You may not, without B-Change’s prior written permission, display or use in any manner, the B-Change Group intellectual property including copyrights, trademarks, names and logos. Any unauthorised reproduction, publication, further distribution or public exhibition of the content provided in the app, whether in whole or in part, is strictly prohibited.

3. Content

The interface and campaign mechanics, including the Missions, rewards redemption criteria and points system, are proposed and created by B-Change and its affiliates. Content such as comments, images and posts that are generated by the app users will result in B-Change. being granted royalty-free rights to those comments, images and posts and in additionally, being entitled to use those comments, images and posts for promotional or other means as determined solely by B-Change. B-Change may not necessarily review all the content posted in the app, but B-Change shall have the right (but not the obligation) in its sole and absolute discretion to pre-screen, refuse, or move any content in the app that B-Change does not agree with or finds objectionable. For the avoidance of doubt, B-Change does not assume any responsibility for the user-generated content in the app, and you shall have no claim or right of compensation against B-Change in the event that B-Change (a) refuses to allow content on the app; (b) moves your content to a different location in the app; or (c) removes your content from the app.

4. Campaign Mechanics

The campaign comprises of Missions that Users must complete. The Missions are as follows: Low Difficulty Missions (100 points required to complete each Mission), Medium Difficulty Missions (500 points required to complete each Mission), and High Difficulty Missions (1000 points required to complete each Mission).

The rewards for each Mission completed entitles Users to be eligible to redeem rewards under the following the conditions: Rewards for Low Difficulty Missions (redeem any reward using 100 points earned during the campaign period), Rewards for Medium Difficulty Missions (redeem any reward using 500 points earned during the campaign period), and Rewards for High Difficulty Mission (redeem any reward using 1000 points earned during the campaign period). Rewards may be claimed at participating partner businesses only.

Points earned from one level of difficulty of Mission are exclusive to that difficulty alone and cannot be used to redeem other difficulty level rewards.

5. Reward Redemption

a) Redemption of rewards is subject to the conditions being met in full by the Users. Stocks of rewards are limited and provision of rewards is subject availability.

b) B-Change will notify all Users who request reward redemptions. If a User does not respond within (7) days of notification from B-Change, B-Change reserves the right to forfeit that User’s eligibility and offer the reward to the next eligible User(s). All decisions by B-Change on this are final.

c) Given that the rewards are to be redeemed by users from third party participating partner businesses only, B-Change shall not be responsible to ensure the availability of such rewards.

d) Employees of B-Change are not eligible to redeem rewards.

e) B-Change reserves the right to end or change the rewards programme at any time.

6. Eligibility

a) Participation in the ‘Explore the Inclusive Side of Singapore’ campaign is eligible to Singapore residents only who are 18 years old and above.

b) B-Change reserves the right to reject Users who do not meet or agree to the aforementioned eligibility criteria.

7. Registration Obligations/User’s representations

a) In consideration for your use of the app, you represent that you are at least 18 years of age and have full capacity to enter into a binding contract.

b) You also agree to (1) provide true, accurate, current and complete information about yourself where prompted by B-Change and (2) maintain and promptly update your personal information to keep it true, accurate, current and complete. Should you provide any information that is untrue, inaccurate, not current or incomplete, or should B-Change have reasonable grounds to suspect that such information provided from you is untrue, inaccurate, not current or incomplete, B-Change shall have the right to suspend or terminate your account and refuse any and all current or future use of the app.

c) In the event of such suspension or termination, you shall have no claim whatsoever against B-Change, and B-Change shall not be liable to you or any third party for any compensation in the event of such suspension or termination.

8. Acceptable Use Policy

a) By using the app, you agree to assume full responsibility and liability for all loss or damage suffered by yourself, B-Change , or any third party as a result of any breach of these Terms & Conditions.

b) You understand and agree that the purpose of the app is to complete Missions to earn rewards whilst contributing valuable data to the minority communities in Singapore with regard to information on inclusive locations and services in Singapore.

c) You agree not to use the app in a manner that may violate any law, statute, ordinance or regulation. Save as permitted by B-Change and subject always to applicable laws and regulations, you shall agree not in relation to your access or use of the app, do or promote, amongst other things, the following:

  • Any event/activity that involves illegal activity
  • Any event/activity/product that involves hate, violence, harm or intolerance in any form
  • Any event/activity/product that relates to credit repair, debt settlement, credit transactions or insurance activities
  • Deceptive business practices such as ponzi/pyramid schemes, multi-level marketing, guaranteed returns, investment or trading courses and services
  • Financial services such as money lending, investment schemes, escrow services, collection agencies, bail bond services, debt collectors, credit aggregation, credit card sales and protection, etc.
  • Gambling activity such as casino games, sports betting, lottery tickets, etc.
  • Any event/activity/product that infringes or violates any intellectual property such as copyrights, trademarks, industrial designs etc.
  • Drugs or narcotics and other controlled substances and devices.
  • Political, religious or spiritual activities
  • Weaponry of any kind including firearms, ammunition, knives and other related products, parts or accessories thereof

9. Submissions

a) B-Change encourages your comments, reviews, images and suggestions in relation to the "Explore the Inclusive Side of Singapore” campaign, which purpose is to encourage users to collect data on the inclusiveness of various locations or services in Singapore. However, such content provided by you shall be and remain the exclusive property of B-Change.

b) Your submission of any such content shall constitute an assignment/transfer to B-Change of all worldwide right, title and interest in all copyright and other intellectual property right to the content. B-Change shall be entitled to use, reproduce, disclose, publish and distribute any such content you submit for any purpose whatsoever, without restriction and without compensating you in any way. For this reason, we ask that you not send us any content that you do not wish to assign/transfer to us, including any confidential information or any original creative material such as stories, product ideas, source code or original artwork.

c) You also agree not to submit any content that may be in violation of law or any agreement or obligation to keep such content confidential. B-Change expressly disclaims any interest to content that you are not authorised to submit. For the avoidance of doubt, any personally identifiable information submitted by you shall be subject to our Privacy Policy.

10. Privacy Policy

a) You acknowledge, consent and agree that B-Change may collect, use, disclose and process your personal data for certain purposes and in a certain manner, which will be explained below. B-Change shall not collect, use, disclose or process your personal data beyond what is necessary and reasonable to provide Users a pleasant experience in using the app. Personal data refers to information about you, from which you are identifiable, directly or indirectly including but not limited to your name, identification number, birth date, passport number, nationality, address, telephone number, credit card information, etc.

b) The provision of your personal data is voluntary. However, if you do not provide B-Change your personal data, your registration in the app may be incomplete and B-Change will not be able to process your personal data for the purposes outlined below and thereby cause B-Change to be unable to allow you to access or use the app.

c) B-Change may collect, use, disclose and process your personal data for business and other activities of the company, which shall include but not be limited to the following purposes:

  • To perform B-Change’s obligations in respect of any contract or agreement entered with you
  • To provide you with access to the app pursuant to these Terms & Conditions
  • To process, manage or verify your registration
  • To validate and/or process any payments (where applicable)
  • To facilitate or enable any checks as may be required
  • To develop, enhance and provide what is required to meet your needs and expectations
  • For internal administrative purposes such as auditing, data analysis, database records
  • For detection, prevention and prosecution of crime under applicable laws, regulations, guidelines or notices issued by any government or regulatory authority (whether Singapore or overseas)
  • For B-Change to comply with its obligations under applicable laws, regulations, guidelines or notices issued by any government or regulatory authority (whether Singapore or overseas)
  • To respond to questions, comments or feedback from you.

d) The collection, use, disclosure and processing of your personal data may be shared with an external third party on the condition that such third party shall be contractually obliged to provide no less security and protection for that data which B-Change currently provides. Except where otherwise provided in these Terms and Conditions, B-Change shall not disclose your personal data to the general public.

e) In addition, B-Change may wish to communicate with you either by electronic mail, telephone or SMS in relation to the following marketing purposes:

  • To process your participation and attendance to any events, promotions, focus groups, research studies, contests, polls, surveys or other activities
  • To send you alerts, newsletters, updates, mailers, promotional activities and other notifications
  • To share your personal data amongst the B-Change Group and its affiliates, third party providers such as developers, advertisers, partners, event companies or sponsors who may communicate with you for reasons whatsoever.


f) If there are changes to your personal data or wish to terminate your account in the app, please update your details by sending the information to the following email address: webmaster@b-change.org. B-Change shall endeavour to effect such changes as requested within fourteen (14) working days upon receipt of such notice of change.

B-Change is fully committed to ensuring complete compliance with the provisions of the Personal Data Protection Act (PDPA) of Singapore. By using the app, you acknowledge, consent and agree to B-Change’s collection, use, disclosure and processing of your personal data.

11. Information Collection and Use

a) B-Change collects information on its Users when they register for an account in the app. When you register, we may ask you for information about you, including your first name, last name, email address, gender and birth year. Once you register with us, you are not anonymous to us.

b) Page visits and app usage may also store information about your computer or mobile device configuration such as your IP address, location, time spent viewing content, cookie information, data extracted, etc, stored within the app. B-Change may use this information to make changes to the app to enhance your app experience and that of other Users.

c) We may also use the information to customise content on the app to display information that may be of interest to you. B-Change will not sell or disclose your information to third parties without your permission.

12. Member Accounts, Passwords and Security

a) You agree that you are responsible for maintaining the confidentiality of your password and account and that you are fully responsible for all activities that may occur under your password or account. You agree to (1) immediately notify B-Change of any unauthorised use of your password or account or any other breach of security, (2) ensure that you exit and logout from your account at the end of each session where necessary, and (3) keep your account information accurate and up to date. B-Change shall not be liable for any loss or damage arising to comply with these obligations.

b) You acknowledge, consent and agree that B-Change may be required to access, preserve or disclose your account information and content if compelled by law or under a good faith belief that such access, preservation or disclosure is reasonably necessary to (1) comply with legal process; (2) enforce these Terms & Conditions; (3) respond to claims that certain content uploaded by you violates the rights of third parties; (4) respond to your requests for customer service; and (e) protect the rights, property and personal safety of B-Change, its users and the general public.

c) You acknowledge, consent and agree that B-Change may retain your personal data, account information and content limited to a specified retention period. At any time you may opt out of receiving any notifications from B-Change through its messaging channels including but not limited to electronic mail, push notifications and SMS.

13. Termination

a) You agree that B-Change may, under certain circumstances and without prior notice, immediately terminate your B-Change account or access to the app. Cause for such termination shall include but not be limited to (1) violation of these Terms & Conditions or other incorporated agreements or guidelines; (2) requests by law enforcement or other government agencies; (3) a request by you (self-initiated account termination); (4) discontinuance or material modifications made to the app; (5) unexpected technical or security issues; (6) extended periods of inactivity; (7) engagement by you in fraudulent or illegal activities; or (8) non-payment of any fees (where applicable) owed by you to B-Change.

b) Termination of your account includes (1) removal of access to the app; and (2) deletion of your password and all related information, files and content associated with your account.

c) Further, you agree that termination with cause shall be made in B-Change’s sole and absolute discretion and that B-Change shall not be liable to you or any third party for any compensation in the event of termination of your account.

14. Third Party Apps, Services and Content

a) Occasionally, third parties may provide content on the app such as advertisements and/or paid content. Because B-Change may not have full control over such content, you acknowledge and agree that B-Change shall not be responsible for such content being made available, and does not endorse such content.

b) B-Change shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use or reliance upon any such content from third parties.

15. Disclaimer

a) B-Change disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, operability, or availability of information and other content displayed in the app. B-Change disclaims any responsibility for the deletion, failure to store, mis-delivery, or untimely delivery of any information or content. B-Change disclaims any responsibility for any harm resulting from the User generated content in the app.

b) All materials, information, products or services included with the app are provided “as is”, with no warranties whatsoever.

c) B-Change and its affiliates, officers, employees, agents, partners, and licensors expressly disclaim to the fullest extent permitted by law (1) all express, implied and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights; (2) any warranties regarding the security, reliability, timeliness and performance of the app; (3) any warranties for any information or content obtained by Users in the app; and (4) any warranties for services or goods received through or advertised on the app.

d) The app may be subject to limitations, delays and other problems inherent in the use of the internet and electronic communications including the device used by you or other Users being faulty, disconnected, out of range of mobile signals or functioning incorrectly, and B-Change shall not be responsible for any such problems arising.

e) Under no circumstances shall B-Change or its affiliates, officers, employees, agents, partners, and licensors be liable for any claim, loss, damage, data loss, costs or expenses incurred (whether direct or consequential), suffered or sustained by you arising from or in connection with your use of the app.

16. Governing law

These Terms and Conditions are governed by Singapore law.

17. Context

Campaign Title: Explore the Inclusive Side of Singapore

Campaign Description: To make Singapore a more inclusive city, we will be giving away rewards to Be Inclusive app users who map out inclusive businesses and services while completing various Missions from November 20-30 2017.

Why Be Inclusive? In Singapore, people with disabilities, single mothers, transgender people and other diverse groups face discrimination when accessing clinics, social support or even restaurants and bars.

Be Inclusive is Southeast Asia’s first-of-its kind mobile app platform that helps minority communities and other diverse groups identify and find everything from non-judgemental doctors to accessible social hangout spots.

  • Rate the child-friendliness of selected restaurants in Arab St/Bugis
  • Rate the Trans-inclusiveness of selected bars and clubs in Tanjong Pagar
  • Rate the wheelchair accessibility of Maxwell Food Centre and 4 other coffee shops within a 1km radius.
  • Rate the wheelchair accessibility of Tiong Bahru Food Centre and 4 other coffee shops within a 1km radius.

High Difficulty Missions (1000 points each):

  • Give feedback about the clinics or hospitals in Singapore with services for Trans or gender nonconforming individuals.
  • Give open-ended feedback about the deaf-friendliness of cinemas in Chinatown/Tanjong Pagar, Arab St/Bugis, Tiong Bahru.
